1. Acceptance of these Terms

These Terms of Service (“Terms”) form a binding agreement between you and EURL TRUSTMYLOC (“Trustmyloc”, “we”, “us”) governing your use of the Trustmyloc mobile application and website (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service does

Trustmyloc automatically measures the time workers spend at addresses chosen by a manager (employer), using the device's location to detect arrivals and departures. The Service records only entry and exit events at tracked addresses; it does not record continuous location or travel routes.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service as a manager. You are responsible for the accuracy of your account information and for keeping your account secure. You are responsible for all activity that occurs under your account.

4. Subscriptions, free trial, billing, and cancellation

  • The Service is free for workers. Only the manager pays a subscription.
  • New manager accounts receive a 30-day free trial. No payment is taken during the trial.
  • At the end of the trial, your subscription begins and your Apple App Store or Google Play account is charged the price of your plan. Subscriptions renew automatically until cancelled.
  • You can cancel anytime in the subscription settings of your Apple or Google account. Cancellation takes effect at the end of the current billing period. Payments are generally non-refundable except where required by law or by the applicable app-store policy.
  • Prices are shown in the Service and may change with notice for future billing periods.

5. Acceptable use

You agree not to misuse the Service, including by: using it for any unlawful purpose; tracking any person without the legal right to do so; attempting to access accounts or data that are not yours; interfering with or disrupting the Service; or reverse-engineering the Service except as permitted by law.

6. Tracking workers — your legal responsibilities

Trustmyloc is a tool. When you use it to track workers, you alone are responsible for complying with all applicable laws, including employment, labor, and privacy laws. Some U.S. states require that you notify and/or obtain the consent of employees before tracking their location. You represent that you have obtained any notice or consent required by law before tracking any worker, and you agree to indemnify us for any claim arising from your failure to do so.

7. Privacy

Our Privacy Policy explains how we handle your information and is incorporated into these Terms.

8. Intellectual property

The Service, including its software, design, and trademarks, belongs to Trustmyloc and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the data you submit; you grant us the rights needed to operate the Service for you.

9. App stores

If you download the app from the Apple App Store or Google Play, that store's terms also apply. Apple and Google are not responsible for the Service and are not parties to these Terms, except that Apple is a third-party beneficiary entitled to enforce them where applicable.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. Location accuracy depends on your device, your settings, and network conditions; we do not warrant that time measurements will be error-free or that the Service will be uninterrupted. You are responsible for verifying records before relying on them for pay, billing, or legal purposes.

11. Limitation of liability

To the fullest extent permitted by law, Trustmyloc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Trustmyloc from any claim, loss, or expense arising from your use of the Service or your violation of these Terms or of any law, including any claim by a worker you tracked.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service unlawfully. On termination, the relevant provisions of these Terms survive (including Sections 6, 8, 10, 11, and 12).

14. Changes

We may update the Service and these Terms. Material changes will be posted here with a new “Last updated” date. Your continued use after changes means you accept them.

15. Governing law

These Terms are governed by French law, without prejudice to the mandatory consumer-protection rules of the country or state where you reside. Nothing in these Terms limits any rights you may have under applicable consumer law.
